Dev Blog: Alliance panel at FanFest 2012 – The Conclusion

As some of you might have heard, one of the Alliance leaders speaking at the Alliance Panel during EVE Fanfest 2012 breached our EULA/TOS with some ill-advised remarks about a fellow EVE player. It goes without saying that CCP deeply regrets this incident and will work towards reducing any possibility of this happening again in the future.

CCP requested that all panel PowerPoint presentations and discussion topics be handed in beforehand for approval. Regrettably, the offending comments were made during an unscripted Q&A session after the main presentations.

Following a thorough internal review CCP has decided to respond to this clear violation of our Terms of Service and wholly inappropriate use of the Alliance Panel. According to our existing policies, we have issued a 30 day ban from EVE Online to the panel speaker.

The policy of CCP is not to publicly discuss warnings and bans on an individual basis. This situation is entirely unique because the panel was displayed via CCP’s Fanfest video stream component, a platform analogous to our forums. As a result we have published this statement due to the special circumstances involved. However, our policy remains that we will not publicly discuss warnings and bans.

The panelist has subsequently posted a public apology as well as a private apology to the victim of his attack. He has also resigned from his position as Chairman of CSM 6 and has forfeited his right to serve on CSM 7. As per our policies, this candidate may be eligible to run at a later date subject to candidacy review.

The Council of Stellar Management is a democratically elected council that represents the players of EVE Online. Although council members may represent the players in any manner they choose, being a council member does not permit actions or playstyles that violate our policies.

    With The Mittani now having been banned from serving on CSM7 and the change to the rules where there are no longer any alternates, it seems the only fair thing to do is to have a re-vote. With The Mittani receiving almost 20% of the votes all alone, that is a huge number of voters whose voice will no longer be heard on the CSM. Is this how CCP wants to have the "player's voice" influenced? With the positive changes they have been making and the beneficial support that CSM6 has given to CCP in a trying year, I believe they will want to do the right thing here and ensure that the disenfranchised voter's voice is heard.

        I am not aware of a precedent (I haven't really looked though) of a constituent getting removed before the term begins though. I can think of a few U.S. Senators that died after being nominated who were able to be replaced despite the rules saying otherwise however.

          In those cases the governor of the state usually appoints someone to fill in their term. I am assuming however that this appointment must be approved by a states legislature, similar to cabinet appointments.

      This course of action sets a very perilous precedent for CCP and how they handle issues of this sort in the future. while I do feel Mittani crossed the line, i also feel that his actions afterword were genuine and benefiting of his position(s). it's a dark day for EVE when we must begin to censor ourselves for fear of the ban-hammer, especially when considering the relatively trivial circumstances and lighthearted surroundings that led up to this.

        ccp is not trying to censor public opinion on individuals, but there is a legal precedent they have to consider that might pot them in the same basket with mittani, so they are trying to defuse the situation without escalation. comments and bloggers are lighting up this issue like a Christmas tree forcing ccp to take actions. best for him to keep a low profile than inflaming the situation, you as goon buddy not helping him or ur alliance.

            Nope… heres the thing…. CCP invited all this media to fanfest, there were reps from sony at the show, and the show was suppose to be focused on DUST. CCP could not do nothing when this dude clearly broke the EULA/TOS, and with DUST being such a big part of the show, and with CCP's partnership with Sony on the DUST launch, there really wasn't much of a choice.

            The isk is not relevant in anyway, no question Sony will ask CCP how they handled this, and CCP can't say, "Oh it's all good, he broke the EULA/TOS, and embarassed us both on live stream, but he sent some dude in game credits, so we can sweep it all under the rug"

      Knee jerk? It's been at least 2 days since the media shitstorm started. They were obviously wrestling with it and this is the outcome. And who says it was resolved amicably? A lot of people were calling for his head. As for the Mackinaw pilot victim, it's irrelevant to me whether he's alive and was given 10B. The Mittani couldn't have known whether the guy was serious or not when he made the statements. The fact that he was OK and was compensated is great, but it's not a defense.

      Some things just aren't done in any context and Mittens should have known better. Just because you can be a douche in a game, doesn't give you license IRL Helicity Boson got perma-banned for a DIAF comment about Soundwave and is only back after a lot of grovelling.

    I think this was a very difficult decision for CCP, it was for me. While I personally feel his apology, personal and public, compensation and refusal of chair were sufficient it seems it wasn't for CCP. Mittens put them in a tough spot, it's difficult to argue it's not a EULA violation and you don't want to be caught publicly ignoring EULA violations. Very possible lawyers told them they had little choice.

      If CCP wasn't trying to introduce Dust during this fanfest and if they hadn't had such a large body of press as a result, this probably wouldn't have happened. But the combination of the strategic partnership with Sony, the media coverage, and the topic of cyberbullying in the news, CCP had to show that it is a mature gaming company with proper deference to human decencies.

      In weighing Mittens' chairmanship and tens of thousands of angry players against the potential fallout from appearing too lax and potentially loosing hundreds of thousands of new Dust and Eve players and having their name dragged through the mud, CCP took the only reasonable route.

    CCP pretty much was forced to do this because of negative press. They just couldn't let The Mittani stay chairman of the CSM, that are supposed represent the EVE community as a whole. That would leave a dark shadow over all EVE players and CCP itself, for harbouring and nurturing this kind of players.

    I don't like Mittens, I don't like Goonswarm but you have to understand CCPs decision, they're just a profit oriented company like every other company out there.

    The Terms of Service say absolutely nothing about suggesting others to do a potentially bannable or even illegal thing. Not even number 1. ToS rule nr 1 would have applied if he had threatened or harassed directly and himself, but he didn't. He suggested others do. That is _not_ covered under the ToS.

    Of course CCP can just decide that enough is enough. That's fair, they can do that. But then they should go out and say that they decided to trash 10000 votes.

    Which wount have mattered. The remark about "make him kills himself" is what made a comment about griefing, into a EUAL violation."

    If he would have said, "gank him untill he uninstalls" would have been ok.
